1. Scope and Contract Formation

These Terms and Conditions apply to all purchases made via the IKS website.

By placing an order, the customer submits an offer to purchase. A contract is concluded when the IKS confirms the order by email confirming dispatch of the goods.

2. Prices and Fees

Prices are indicated on the website at the time of ordering and are stated in USD unless otherwise specified.

The IKS is subject to tax exemption, VAT is not charged on its prices.

The IKS reserves the right to modify prices at any time; however, prices already confirmed in an order will not be affected.

3. Payment Methods

Payment may be made via:

  • PayPal
  • Credit or debit card via SimplePay

Payments are processed through secure, encrypted channels by third-party payment providers. The IKS does not store card details.

Recurring Card Payments (SimplePay)

Recurring credit card payment (hereinafter referred to as Recurring payment) is a function included in the acceptance of credit cards provided by SimplePay meaning that in the future it is possible to make payments with credit card details provided by the Customer during the registration transaction without giving credit card details again. One of the types of recurring payment, the so-called “ad-hoc payment” is made with the approval of the Customer during each transaction, so you have to approve all transactions in the case of each future payment. You will receive a notification of the successful payment through channels identical with conventional credit card payments in every case.

By accepting this statement to use recurring payment, you allow to make subsequent payments made from your user account in this online store (https://iks.hu/shop/) without providing credit card details again after the successful registration.

Please note: the processing of credit card details is in accordance with the rules of card issuers. Neither the merchant nor SimplePay has access to the credit card data. The Supplier shall assume direct liability for false or unauthorized recurring payments initiated by the Supplier, any claim enforcement against the Supplier’s payment service provider (SimplePay) shall be unavailable.

3.1. Provisions especially for recurring credit card payments

  • By making a membership purchase on the IKS.hu website, the User expressly consents to the Service Provider re-debiting the yearly membership fee that will become due in the future using the bank card details provided during the first transaction without having to re-enter the card.
  • Recurring payment type: Periodic debit. Debit frequency: every year on the given due date.
  • The Service Provider is obliged to send the User an e-mail notification of the current due amount and the debit date prior to the debit.
  • The User is entitled to cancel the recurring payment at any time by sending an e-mail to office@iks.hu, no later than 31 days before the next debit due date.
  • The transaction is secured by SimplePay Plc. through the SimplePay Plc.’s system, the bank card data is handled in accordance with banking security regulations, and the Service Provider does not have access to them.

4. Order Processing and Delivery

  • Orders are confirmed by email upon receipt.
  • Customers will be informed if items are unavailable. No substitutes will be sent without consent.
  • Delivery:
    • Within Europe: surface mail
    • Outside Europe: airmail
  • Dispatch typically occurs within one week.

5. Membership

Membership fees grant benefits for a period of 12 months, as described on the website.

6. Right of Withdrawal (EU Consumers)

Consumers have the right to withdraw from the contract within 14 days without giving any reason, in accordance with the Consumer Rights Directive (2011/83/EU).

The withdrawal period expires 14 days after the day on which the customer acquires physical possession of the goods.

To exercise the right of withdrawal, the customer must inform IKS by email.

Effects of Withdrawal

  • The customer must return the goods without undue delay and no later than 14 days after notifying withdrawal.
  • Goods must be returned in appropriate condition.
  • The customer bears the direct cost of returning goods unless otherwise agreed.

Refunds

  • All payments, including standard delivery costs, will be reimbursed within 14 days of receiving the returned goods or proof of return.
  • Refunds will be made using the original payment method.

7. Returns and Defective Goods

If goods are defective or incorrectly supplied, the customer is entitled to remedies under Hungarian law, including repair, replacement, or refund.

8. Complaints and Legal Remedies

Customers may submit complaints using the contact details above.

Consumers may also turn to:

  • the competent consumer protection authority in Hungary
  • the European Commission’s Online Dispute Resolution platform

9. Data Protection (Privacy)

The IKS processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Hungarian law (Act CXII of 2011).

Key principles:

  • Data is processed solely for contract performance, legal obligations, or legitimate interests
  • Data is shared only with service providers necessary for fulfilment (e.g. payment processors, delivery services)
  • Data subjects have the right to access, rectify, erase, and restrict processing of their personal data

Payment data is handled exclusively by secure third-party providers.

Payment Data Transfer

The following personal data stored in the user account of the data controller International Kodály Society (H-1149 Budapest, Róna u. 120–122., Hungary) in the user database of https://iks.hu/ will be handed over to SimplePay Plc. and is trusted as data processor. The data transferred by the data controller are the following: name, email address, provided billing address

10. Limitation of Liability

The IKS is not liable for delays caused by postal services or circumstances beyond its control, except where required by law.

11. Amendments

The IKS reserves the right to amend these Terms and Conditions. Changes do not affect contracts already concluded.
